L&E Section Listserv (“LEstserv”) Rules & Guidelines

The purpose of this Labor and Employment Law Section of The Florida Bar’s (“L&E Section”) listserv is to allow members of the L&E Section to exchange ideas, opinions, information, and comments in a positive and professional environment. Discussions of labor and employment topics and L&E Section matters will be open to all L&E Section members in good standing.

By using the L&E Section’s listserv (called the “LEstserv”), the user acknowledges that she/her is responsible for reading these RULES AND GUIDELINES in its entirety, agrees to abide by all of the rules contained in the RULES AND GUIDELINES, and understands that non-compliance may result in removal from the LEstserv.

The LEstserv is a tremendous resource and can help to educate us all—so enjoy, but please respect the purpose, goals, and rules of the LEstserv. Members who do not follow these RULES AND GUIDELINES will be removed from the LEstserv.

RULES FOR LISTSERV PARTICIPATION

  1. No swearing, raging, posting foul or abusive language, or unprofessional messages. This includes flames, obscenities, verbal harassment, or comments that would prove offensive based on race, sex, religion, etc. Complaints about other members should be directed to the LEstserv Moderator. Anyone violating this rule will lose LEstserv privileges immediately.
  2. Do not send little messages like “I agree,” “Me too,” “Thanks,” “Understood,” “Good idea,” “Okay,” or other quips to the entire list. Personal exchanges and comments should be taken to a private e-mail exchange. You may do so by changing the “To” field or clicking on your “Forward” button and typing in or cutting and pasting in the e-mail address of the individual to whom you are responding. Remember, anything you post to the LEstserv must be opened and read by ALL members, so do not send these types of messages.
  3. Please do not include large quotes when replying to posts. Include only what is needed to show what you are responding to.
  4. If you are going to send something not directly related to the L&E Section business, then put something in the subject line such as “Subject: Off-topic.” But such off-topic discussions should avoid personal matters (i.e., sending messages expressing support for amateur and professional sports teams or colleges/universities).
  5. Unauthorized advertising, promotional materials or direct advertising is not allowed without the LEstserv Moderator’s prior approval. This is defined as conferences/seminar announcements, business services, products, marketing pieces, announcement of performances, press releases, firm announcements, personal achievements, and of course, spam. References to commercial products and services may be made when directing members to answers or more information on a subject. For example, if a member asks for recommendations of mediators (i.e., “Can anyone recommend a mediator in the Sarasota area?”), then someone responding to the question may indicate that he/she can handle the mediation, but additional comments should be kept to an absolute minimum and otherwise direct the questioner to contact him/her by personal e-mail or telephone for additional information.
  6. Do not send “test messages” to the LEstserv to see if things are working. If you think that there is a problem, then please contact the LEstserv Administrator or the LEstserv Moderator.
  7. All LEstserv participants are required to ensure that all postings (including attachments) are virus/malware free and are transmitted by systems utilizing up-to-date anti-virus/security software.
  8. The LEstserv Moderator makes all day-to-day working decisions about the LEstserv. The LEstserv Moderator reserves the right to make any day-to-day decisions necessary for the LEstserv to operate smoothly and effectively. Please understand that submissions to the LEstserv may not be uploaded immediately. If a matter is time sensitive, you should contact the LEstserv Moderator directly to alert him/her to the time-sensitive nature of the request.
  9. DO NOT SET YOUR LESERV E-MAIL ADDRESS TO AUTO-RESPOND TO LESERV MESSAGES. If you are unavailable or need to turn on your “out of the office” rule, you must unsubscribe from the LEstserv temporarily and subscribe again when you return. Auto-responders will “loop” and respond to each auto-response causing a myriad of messages to be posted to the LEstserv. As a matter of good practice, if you have an auto-respond on, then you should be sure to select the preference/setting that an auto-respond message will be sent only once to each sender.
  10. Fake/false virus warnings, charitable appeals, and urban legends are not allowed. If you are unsure whether your message falls into this category, then forward it to the LEstserv Moderator first! Also, try checking the following website first: http://www.kumite.com/myths/.
  11. Do not post any information or other material protected by copyright without the permission of the copyright owner. By posting material, the posting party warrants and represents that he/she owns the copyright with respect to such material or has received permission from the copyright owner. In addition, the posting party grants the L&E Section and users of the LEstserv the non-exclusive right and license to display, copy, publish, distribute, transmit, print, and use such information or other material.
  12. Anyone attempting to hack the LEstserv will lose all privileges without the possibility of reinstatement!
  13. The L&E Section reserves the right to terminate access to any user who does not abide by the LEstserv RULES AND GUIDELINES and reserves the right to terminate access to any user who is not in good standing with the L&E Section. To the extent a member’s access to the LEstserv is terminated by the LEstserv Moderator, the individual has a right to appeal that decision to the L&E Section’s Website Sub-Committee. The appeal must be submitted in writing to the Chair of the Website Sub-Committee no later than five business days after the termination of access rights. If no written appeal is received within five business days of the termination of access rights or a written appeal is submitted more than five business days after the termination of access rights, then the decision of the LEstserv Moderator shall be binding and there shall be no further right to appeal the decision. In the event of a timely received appeal, the decision of the Website Sub-Committee shall be binding and there shall be no further right of appeal.

ETIQUETTE RULES AND TIPS ON THE POLITE USAGE OF THE LISTSERV

  1. ORIGINAL POST-TITLE APPROPRIATELY - When you are the person posting a question, be sure that you title your posting with a good, concise, explanatory title in the subject line.
  2. REPLIES & ME TOOs - If your message is an informative response to someone’s question, from which everyone can learn, then you should respond and send your reply message to everyone. However, try to avoid re-sending the entire message you are replying to. Cut and paste the relevant parts when replying, and never re-send a digest back to the LEstserv. Remember: when you click on “reply” to a posting, your response is posted to the entire LEstserv.
  3. AUTO-SIGNATURE - Always remember to include a full “auto-signature” block at the bottom of your messages so that other subscribers will know who you are and how to reach you directly. Please consult the help file of your specific e-mail software for more information on how to create an “auto-signature” block.
  4. ATTACHED FILES - Attachments are allowed, although there are certain size restrictions.

Members of Florida Bar entities communicate via this site. Consequently, any communication via this site may be subject to monitoring and disclosure to third parties.

The LEstserv Moderator (or other person designated by the Executive Council of the L&E Section) has the right to delete any inappropriate content from the LEstserv, including but not limited to: irrelevant content, redundant content, hateful content, malicious content, uncivil or disrespectful content, attacks or complaints against an individual, financial solicitations, endorsements of a political candidate or party, opposition to a political candidate or party, and content that violates The Florida Bar rules. Content that violates Florida Bar rules may also be reported.

The L&E Section reserves the right to terminate access to any user who does not abide by the LEstserv RULES AND GUIDELINES and reserves the right to terminate access to any user who is not in good standing with the L&E Section.

The Officers of the L&E Section and The Florida Bar reserve the right to amend and alter these RULES AND GUIDELINES as needed.
